Terms and
Conditions
The Rigpa Distance
Learning Program is part of Rigpa Fellowship, which is incorporated as a 501
(c) (3) religious non-profit organization. ZAM America, the publishing arm
of Rigpa Fellowship, which is also incorporated as a 501 (c) (3) religious
non-profit organization, produces and sells the course materials for the
courses offered by the Rigpa Distance Learning Program. All information,
goods and services are hereafter referred to as products. Rigpa Fellowship,
ZAM America or any of their agents, officers, instructors, facilitators,
employees etc. are hereafter referred to as providers.
Shipping:
We ship most of our materials via the United States Postal Service. While
their service is very fast and reliable within the US we cannot guarantee
delivery time for shipments, especially to destinations outside of the
United States. If the mail service in your country is not reliable please
contact us before registering or ordering to make alternate shipping
arrangements. If your online course materials do not arrive in time for you
to participate in the course we will be happy to defer your registration to
the next scheduled course (if the course will be offered again in the next
term) or offer you the possibility to return the materials.
Returns and refunds:
We will gladly accept returns for a full refund (not including shipping
charges) within 30 days of receipt if the products are returned in an
unopened and unused condition. In any event, any liability of the provider
shall not exceed the amount paid by you for the products provided by Rigpa
and ZAM. Before returning materials you must contact ZAM America for a RMA
(Return Merchandise Authorisation) number.
Liability:
The products provided through the providers are based on Tibetan Buddhist
teachings and are solely intended to broaden your understanding and
knowledge of religious and spiritual topics. They are not intended as a
substitute for medical treatment or psychotherapy. If you have physical,
psychological or psychiatric problems we recommend you consult your
professional health care provider before registering. Your relationship with
Rigpa and its providers is not a physician-patient, psychotherapist-patient
or priest-penitent relationship. Nothing contained in any course is intended
to be, and must not be taken to be, the practice of medicine, including
psychology, psychiatry or psychotherapy or providing health care advice or
instruction for diagnosis or treatment. You acknowledge and agree that the
providers shall not be held responsible or liable directly or indirectly for
any damage or loss caused or alleged to be caused by or in connection with
use (including inability of use) of or reliance on any information, goods or
services provided. Rigpa Fellowship will also not be liable for any
statements or conduct of any of its providers and users/participants or any
information provided by them. Rigpa or any provider does not warrant the
accuracy, legality, or appropriateness of any of the provided information
including information provided by other users/participants or give an
endorsements of links and references to third party materials. These are
provided for your convenience and are solely intended to broaden your
understanding and knowledge of religious and spiritual topics.
Warranties:
Our products are provided “as is”, “as available” and without warranties of
any kind, including that your use of the online course discussion will be
uninterrupted, error free, or secure. Rigpa will not be responsible for
damage resulting from viruses or other harmful components. The users of this
product assume all risks of use and shall indemnify the providers from and
against any and all damages, liabilities, losses, costs, and expenses,
including reasonable attorney’s fees, arising out of or related to use of
information, services or products offered by Rigpa Fellowship.
Copyright:
Our products are protected by copyright (and other intellectual property
laws) and are provided to you for your personal use only. No reproduction
and distribution of materials without written permission is allowed.
Requests regarding use of any content for use other than personal,
noncommercial use should be directed to Rigpa Fellowship. The information
and postings on the discussion boards and email groups are provided for your
personal use and not for reproduction and distribution to others.
Locations outside the
United States: Rigpa makes no
representation that the products provided are appropriate or available for
use in locations other than the United States. Those who choose to
participate from other locations do so on their own initiative and their own
risk and are responsible for compliance with local laws, if and to the
extent applicable.
Termination of
service: We reserve the right to
limit participation to any person in any geographic area or jurisdiction we
so desire, at any time and in our sole discretion and to limit the number of
participants or quantities of products we provide. Rigpa reserves the right
to terminate at any time the participation of any user who, in Rigpa’s sole
discretion, violates this terms of service agreement.
Monitoring content of
website or email postings: The
providers have no obligation to monitor the postings on the discussion
boards or email lists. However, you acknowledge that they have the right
(but not the obligation) to monitor the messages and materials that you
post; to alter or remove any such materials (including messages to message
boards); to disclose such materials and the circumstances of their
transmission to any third party in order to operate the site properly; to
protect ourselves, our sponsors and visitors; and to comply with legal
obligations and government requests. Rigpa owns the right to publish
messages board posts or discussion group emails in other formats.
Participant
responsibilities: The purpose of
the discussion groups and email groups and other forms of correspondence in
the distance learning courses is to discuss the topics of the courses. While
participating in our courses you agree to (1) respect the rights of other
participants. (2) communicate in respectful and courteous ways. (3) to
abstain from threatening, discriminatory, objectionable, defamatory or
harmful statements. (4) to not send unsolicited advertising. (5) to provide
true and accurate information when you register and to notify us of changes
in this information in a timely manner. You are responsible for any
information that you send to providers and participants or post on Rigpa
message boards or email discussion groups. In case you create (or a provider
provides you with) a username and password you are responsible for
maintaining the confidentiality and are responsible for any activity that is
conducted through your account.
Legal matters:
Rigpa reserves the right to change the terms of service at any time. The
terms of service and the relationship between you and Rigpa Fellowship and
its providers shall be governed by the law of the State of New York without
regard to its conflict of law provisions. You agree to submit to the
personal and exclusive jurisdiction of the federal and state courts located
within the county of Albany in the State of New York and to submit any
jurisdictional, venue or inconvenient forum objections to such courts. You
agree that any cause of action you may have with the service must be filed
within one year after the cause of the action arises or the cause is barred.
The failure of a provider to exercise or enforce any right or provision of
the terms of service shall not constitute a waiver of such right or
provision. If any provision of these terms of services is found by a court
of competent jurisdiction to be unlawful, void or for any reason
unenforceable, then this provision shall be deemed severable from this
agreement and shall not affect the validity and enforceablility of any
remaining provisions.
California residents:
Under California Civil Code Section 1789.3, California residents are
entitled to the following specific consumer rights information: The
Complaint Assistance Unit of the Division of Consumer Services of the
